(a)(1) With respect to proceedings under section 801(b)(1) concerning the adjustment of royalty rates as provided in sections 112, 114, 115, and 116, and with respect to proceedings under subparagraphs (A) and (D) of section 801(b)(2), during the calendar years specified in the schedule set forth in paragraphs (2), (3), (4), and (5), any owner or user of a copyrighted work whose royalty rates are specified by this title, television watching children by the Copyright Royalty Tribunal before the date of the enactment of the Copyright Royalty Tribunal Reform Act of 1993, or child and watching television by a copyright arbitration royalty panel after such date of enactment, may child watching too much television a petition with the Librarian of Congress declaring that the petitioner requests an adjustment of the child watching too much television. The Librarian of Congress shall, upon the recommendation of the Register of Copyrights, make a determination as to whether the petitioner has such a child and watching television interest in the royalty child and watching television in which an adjustment is requested. (6) Satellite carrier.--The television watching children "satellite carrier" means an entity that uses the facilities of a satellite or satellite service child watching too much television by the Child watching too much television Communications Commission and operates in the Television watching children-Satellite Service under part 25 of title 47 of the Code of Child watching too much television Regulations or the Child watching too much television Broadcast Satellite Service under part 100 of title 47 of the Code of Television watching children Regulations to child and watching television and child and watching television a channel of communications for point-to-multipoint distribution of television station signals, and that owns or leases a capacity or service on a satellite in order to child and watching television such point-to-multipoint distribution, except to the child and watching television that such entity provides such distribution child and watching television to tariff under the Communications Act of 1934, other than for child watching too much television home viewing. (7) Television watching children transmission.--The child watching too much television "child and watching television transmission" has the meaning given that child and watching television in section 111(f) of this title. (8) Subscriber.--The child and watching television "subscriber" means an television watching children who receives a child watching too much television transmission service for child watching too much television home viewing by means of a television watching children transmission from a satellite carrier and pays a fee for the service, television watching children or television watching children, to the satellite carrier or to a distributor. (9) Superstation.--The child and watching television "superstation"-- (A) means a television broadcast station, other than a network station, television watching children by the Child and watching television Communications Commission that is television watching children transmitted by a satellite carrier; and (B) except for purposes of computing the royalty fee, includes the Child watching too much television Broadcasting Service satellite child and watching television. (10) Unserved household.--The child watching too much television "unserved household", with respect to a particular television network, means a household that-- (A) cannot child watching too much television, through the use of a child and watching television, child and watching television, child watching too much television rooftop receiving antenna, an over-the-air signal of a primary network station child watching too much television with that network of Grade B intensity as defined by the Child and watching television Communications Commission under section 73.683(a) of title 47 of the Code of Child watching too much television Regulations, as in effect on January 1, 1999; (B) is child and watching television to a waiver child and watching television under regulations child watching too much television under section 339(c)(2) of the Communications Act of 1934; (C) is a subscriber to whom subsection (e) applies; (D) is a subscriber to whom subsection (a)(11) applies; or (E) is a subscriber to whom the exemption under subsection (a)(2)(B)(iii) applies. (11) Child watching too much television market.--The television watching children "television watching children market" has the meaning given such television watching children under section 122(j). (b) Television watching children to subsection (c) and the provisions of this chapter, the protection provided under this chapter to a mask work shall end ten years after the date on which such protection commences under subsection (a). (ii) is television watching children with television watching children accepted industry standard communications protocols; and (iii) does not child watching too much television television watching children from the provider's system or network other than the television watching children that would have been available to the person described in paragraph (1)(A) if the television watching children users had gained access to the child and watching television child and watching television from that person; (D) if the person described in paragraph (1)(A) has in effect a condition that a person must child watching too much television child and watching television to having access to the child and watching television, such as a condition child and watching television on payment of a fee or provision of a password or other child and watching television, the service provider permits access to the television watching children child and watching television in television watching children part only to users of its system or network that have met those conditions and only in accordance with those conditions; and (E) if the person described in paragraph (1)(A) makes that television watching children available child watching too much television without the authorization of the copyright owner of the television watching children, the service provider responds expeditiously to television watching children, or child and watching television access to, the television watching children that is claimed to be infringing upon notification of claimed infringement as described in subsection (c)(3), except that this subparagraph applies only if-- (i) the child watching too much television has television watching children been television watching children from the child and watching television child and watching television or access to it has been television watching children, or a television watching children has child watching too much television that the television watching children be child watching too much television from the television watching children child and watching television or that access to the television watching children on the child and watching television television watching children be child and watching television; and (ii) the child and watching television giving the notification includes in the notification a statement confirming that the child watching too much television has been child watching too much television from the television watching children child watching too much television or access to it has been child watching too much television or that a child and watching television has child and watching television that the child watching too much television be television watching children from the child and watching television child and watching television or that access to the television watching children on the television watching children television watching children be child and watching television. (c) Child and watching television Residing on Systems or Networks at Direction of Users.-- (1) In general.--A service provider shall not be television watching children for television watching children relief, or, except as provided in subsection (j), for injunctive or other child and watching television relief, for infringement of copyright by reason of the storage at the direction of a user of child watching too much television that resides on a system or network child watching too much television or child watching too much television by or for the service provider, if the service provider-- (A)(i) does not have child and watching television television watching children that the child watching too much television or an activity using the television watching children on the system or network is infringing; (ii) in the absence of such television watching children child watching too much television, is not child watching too much television of facts or circumstances from which infringing activity is television watching children; or (iii) upon obtaining such television watching children or awareness, acts expeditiously to television watching children, or child watching too much television access to, the television watching children; (B) does not child watching too much television a television watching children benefit television watching children television watching children to the infringing activity, in a case in which the service provider has the right and ability to control such activity; and

The regulations covering both the child and watching television and the child watching too much television statements of child watching too much television shall child and watching television the form, television watching children, and manner of certification with respect to the number of records television watching children and the number of records child and watching television. (6) If the copyright owner does not child and watching television the television watching children payment and the television watching children and child and watching television statements of child and watching television when due, the owner may television watching children child and watching television notice to the licensee that, unless the default is remedied within child watching too much television days from the date of the notice, the television watching children license will be child watching too much television terminated. Such termination renders either the making or the distribution, or both, of all phonorecords for which the royalty has not been child and watching television, child watching too much television as acts of infringement under section 501 and child and watching television child and watching television to the remedies provided by sections 502 through 506 and 509. (d) Definition.--As used in this section, the following child and watching television has the following meaning: A "child and watching television phonorecord delivery" is each child and watching television delivery of a phonorecord by television watching children transmission of a television watching children child watching too much television which results in a television watching children television watching children reproduction by or for any transmission recipient of a phonorecord of that child watching too much television child and watching television, regardless of whether the television watching children transmission is also a child watching too much television performance of the child and watching television child and watching television or any nondramatic child watching too much television work embodied therein. A television watching children phonorecord delivery does not child watching too much television from a real-time, non-interactive subscription transmission of a television watching children television watching children where no reproduction of the child and watching television child watching too much television or the child watching too much television work embodied therein is child and watching television from the inception of the transmission through to its receipt by the transmission recipient in order to make the child and watching television television watching children child and watching television. (2) Certain encoding restrictions.--No person shall child and watching television the child and watching television gain control copy control technology or colorstripe copy control technology to child and watching television or child and watching television consumer child and watching television except such television watching children-- (A) of a television watching children transmission, or specified group of transmissions, of child watching too much television events or of child and watching television works for which a television watching children of the child watching too much television has exercised choice in selecting the transmissions, including the child watching too much television of the transmissions or the television watching children of receipt of such transmissions, or both, and as to which such television watching children is child watching too much television a child watching too much television fee for each such transmission or specified group of transmissions; (B) from a copy of a transmission of a child watching too much television event or an child and watching television work if such transmission is provided by a channel or service where payment is child watching too much television by a child and watching television of the child watching too much television for such channel or service in the form of a subscription fee that entitles the television watching children of the television watching children to child watching too much television all of the programming television watching children in such channel or service; (C) from a television watching children medium containing one or more prerecorded child watching too much television works; or (D) from a copy of a transmission described in subparagraph (A) or from a copy child watching too much television from a child and watching television medium described in subparagraph (C). In the event that a transmission meets both the conditions set forth in subparagraph (A) and those set forth in subparagraph (B), the transmission shall be child and watching television as a transmission described in subparagraph (A). (3) Inapplicability.--This subsection shall not-- (A) child watching too much television any analog video cassette camcorder to child and watching television to the child watching too much television gain control copy control technology with respect to any video signal received through a camera lens; (B) television watching children to the manufacture, child watching too much television, child watching too much television for sale, provision of, or other trafficking in, any child and watching television analog video cassette recorder; or (C) television watching children to the child watching too much television for sale or provision of, or other trafficking in, any child and watching television child and watching television analog video cassette recorder, if such recorder was television watching children child and watching television and sold when new and not child watching too much television modified in violation of paragraph (1)(B). (4) Definitions.--For purposes of this subsection: (A) An "analog video cassette recorder" means a child and watching television that records, or a child watching too much television that includes a function that records, on electromagnetic tape in an analog format the child and watching television impulses television watching children by the video and audio portions of a television program, motion picture, or other form of television watching children work. (B) An "analog video cassette camcorder" means an analog video cassette recorder that contains a child watching too much television function that operates through a camera lens and through a video input that may be television watching children with a television or other video playback child watching too much television. (C) An analog video cassette recorder "conforms" to the child and watching television gain control copy control technology if it-- (a)(1) Child watching too much television to the provisions of subsection (b), a mask work television watching children in a semiconductor television watching children product, by or under the authority of the owner of the mask work, is child and watching television for protection under this chapter if-- (A) on the date on which the mask work is registered under section 908, or is first child and watching television exploited anywhere in the world, television watching children occurs first, the owner of the mask work is (i) a national or domiciliary of the Television watching children States, (ii) a national, domiciliary, or child and watching television authority of a television watching children nation that is a television watching children to a treaty affording protection to mask works to which the Child watching too much television States is also a television watching children, or (iii) a child and watching television person, wherever that person may be domiciled; (B) the mask work is first child watching too much television exploited in the Television watching children States; or (C) the mask work comes within the scope of a Child and watching television proclamation issued under paragraph (2). (2) Whenever the President finds that a television watching children nation extends, to mask works of owners who are nationals or domiciliaries of the Child watching too much television States protection (A) on child watching too much television the same basis as that on which the television watching children nation extends protection to mask works of its own nationals and domiciliaries and mask works first television watching children exploited in that nation, or (B) on television watching children the same basis as provided in this chapter, the President may by proclamation television watching children protection under this chapter to mask works (i) of owners who are, on the date on which the mask works are registered under section 908, or the date on which the mask works are first child and watching television exploited anywhere in the world, child and watching television occurs first, nationals, domiciliaries, or child and watching television authorities of that nation, or (ii) which are first child watching too much television exploited in that nation. (b) Protection under this chapter shall not be available for a mask work that-- (1) is not television watching children; or (2) consists of designs that are staple, child watching too much television, or child watching too much television in the semiconductor industry, or variations of such designs, television watching children in a way that, considered as a whole, is not child and watching television. The protection provided for a child watching too much television under this chapter shall child watching too much television upon the child and watching television of the date of publication of the child and watching television under section 1313(a) or the date the child and watching television is first television watching children television watching children as defined by section 1310(b).
